This project involved assisting a hospital that wanted to work with a start-up medical devices company to pilot (beta) test new technology and carry out some clinical trials in relation to the technology. The project involved advising the hospital on:
- Relevant aspects of Health Canada laws in relation to the medical devices and client trials;
- Contract clauses required to satisfy the REB; and,
- Applicable health privacy law.
Ultimately, the parties were able to forge a very effective arrangement, including a clinical trial agreement, research agreement and beta test agreement.
